How executions work
A judgment the firm wins is not yet money in the client's account or a right restored. The Executions app follows what comes after: asking the execution court to enforce the judgment, and every step until it is fully enforced.
The file
An execution file names the client and the client's role: Executor when the client asks for the enforcement, Executor against him when the judgment is enforced against the client. It names the other parties, the lawyers, the execution court and the number the court gave it. Its Type says what is enforced: Financial for money, Direct for an act, Family Matters for personal status.
Only courts marked Execution Court can receive a file, so the list stays short and correct.
Where a file comes from
A file can start on its own, or from what came before it:
- a case with a won or lost primitive or final judgment, or a canceled case;
- a consultation, when the firm advised on an enforceable document;
- a client request of type Execution, approved by the firm.
The file keeps the link in Other Info, and the case, consultation or request counts its files.
The life of a file
A file starts as a Draft, goes In Progress when the work starts, and ends Finished, Suspended or Rejected, each with its reason and date. A suspended file goes back In Progress when the obstacle is gone; meanwhile each of its lawyers has a to-do to resume it.
While it is in progress, the file gathers what happens before the court:
- enforcement procedures, the requests the firm files, each moving from Review to In Progress, then Finished or Rejected;
- decisions of the execution judge and sessions with their minutes;
- hearings, when the file needs one, kept with the cases' hearings.
The money
A financial file records the Total Amount awarded, the Reserved Amount the court holds, and every payment collected with its payer, date and method. Paid Amount and Remaining Amount follow from the payments. The firm's own fees are a separate matter: Create Invoice bills them, and the file shows what was invoiced and what is unpaid.
Who sees what
Access to executions has three levels in the Legal Rights section of a user:
- Read-only reads every file of the company and its reports, without changing them.
- User: Own Documents works on the files where they are one of the lawyers or a follower.
- Manager: All Documents works on every file and opens the Configuration menu.
The settings decide what the clients receive by e-mail (a new state, a new procedure, a new decision), whether lawyers get a periodic reminder of their open files, and the number of days given to resume a suspended file.
